It is obvious that the conditions of the legislation of the prophet ruling justifications, absolute conditions ( the orders of the god), the low of prophet (sunnas), also the the basis of low decisions of the state council (shura) have been investigated. In this article it is mentioned the states which have been appearred in the Arabic peninsula under the ruling of the prophet as well as its specific features have been discussed. In the period of development and enhancement of the Islamic states the "Book of the agreement of Madina" has been identified as well as the origin and the basis of the given legislation documents preparation and its acceptance with the meaning have been concluded. Thus, in the article the political situation is comprehensively considered during the acceptance of "The book of the agreement of Madina". Also the various political ideas concerning the reform of moving from Mecca to Madina as well as the steps of formation of the sovereign Islamic state has been analyzed and Mohammed's (s.g.a.) agreements with different religious aspects for achieving this purpose have been reviewed. In this article the prerequisites of appearing of the Islamic state on the Arab peninsula in the 662nd year and "The book of the agreement of Madina" have been comprehensively scientifically analyzed.
